At least two things have changed in the last generation with regard to child relocation. Society and the law recognize the mutual need of children for both parents. And society has become more mobile. How are these conflicting circumstances reconciled?

We may need to move in order to take advantage of a job offer, to care for aging parents, or to start a new, loving relationship. But this makes it more difficult for the other parent to see the child.

Rule number one in any law or order relating to children is that it must prioritize the "best interests of the child." Does the new job provide more stabile income and support? Is added travel more difficult for the child?

As a basis, you or your ex can move up to three hours away without the permission of the other, or a court. However, this does not include moves across state boundaries. Courts have a defined jurisdiction that does not include parties in another state. If you want to move to another state or district you must have the permission of the court. This may be difficult if the other parent opposes the move. Bear in mind that there may be criminal penalties for relocating with a child illegally.

Courts generally balance the needs of the parties, so, for example, you might be allowed to move if you make some concession that makes the other parent's visitation less difficult.
